California's SB 343 takes effect on 4 October, forcing brands to prove recyclability claims or strip them from packaging.

America's biggest consumer market is about to redraw the rules for packaging. Beginning 4 October 2026, California's SB 343, better known as the Truth in Recycling law, will prohibit recyclability claims unless packaging meets strict collection and sorting standards.
The change reaches far beyond California. Any manufacturer selling products in the state must prove that a material clears both 60% infrastructure thresholds before using recycling claims or even the familiar chasing arrows symbol. Companies that fail to comply could face civil penalties of up to $2,000 per item, making packaging audits an urgent priority.
The compliance clock began ticking when CalRecycle published its final Material Characterization Study on 4 April 2025. That report established the data companies must use to justify recyclability claims, leaving many commonly used plastics and multi-layer materials at risk of losing their environmental labels.
For national brands, creating California-only packaging is rarely practical. Most are expected to review entire product portfolios instead, pulling packaging engineers, legal teams, procurement specialists, and marketers into the same compliance effort. Retailers face growing pressure as well, with supplier verification becoming just as important as shelf space.
The deadline is now close enough to shape production schedules. Businesses that complete redesigns early can avoid costly disruptions while reinforcing consumer confidence through accurate environmental claims. In a market where sustainability messaging increasingly influences buying decisions, verified labels may soon become as valuable as the products they appear on.
